    A COMPARATIVE ANALYSIS ON INTERNATIONAL REFUGEE LAW AND TEMPORARY PROTECTION IN THE CONTEXT OF TURKEY

    The Syrian civil war prompted a large number of people to flee their country and seek asylum in other countries, making Turkey a leading host country with around 3.6 million of asylum seekers. Syrian asylum seekers in Turkey are under temporary protection regime. This article examines Turkish temporary protection regime in comparison with international protection standards and human rights law, especially with the UNHCR Guideline and European Union legislation on temporary protection and European Court on Human Rights judgements. In this respect, this article argues that Turkish legislation has met the fundamental requirements of international protection law and standards, however, still needs to be improved in some crucial areas. In this regard, the international protection law and the difference between the status of refugee and temporary protection is explored. Subsequently, declaration of temporary protection in case of a mass-influx, the rights and freedoms covered under temporary protection, non-refoulement principle and termination of temporary protection regime under Turkish Temporary Protection Regulation are discussed and compared with the international standards. Finally, some conclusions and recommendations for the improvement are deduced from this discussion.

    Myanmar, International Crimes and International Community: Response of International Community to the Grave Crimes Committed Against Itself

    This article seeks to understand the capacity of the international community to respond to genocide and crimes against humanity by assessing the accountability mechanism established for such crimes in the case of Myanmar. It carries out a multi-layered analysis of the question of how the international community triggers international mechanisms to address genocide and crimes against humanity. Despite the United Nations Security Council refraining from taking effective action and making decisions that would have applied appropriate measures, this study concludes that the initiatives of the international community, states, and international organizations possess the capacity to trigger international jurisdiction to punish the perpetrators of such grave international crimes and that international judicial institutions bolster the common values and interests of the international community in such cases.

    SOCIAL MEDIA AND FREEDOM OF EXPRESSION: A SURVEY ON UNIVERSITY STUDENTS IN TURKEY

    Freedom of expression is one of the most important foundational elements of individual realization and democratic society. Social media is the current most preferred and primary form of communication for young people. Social media is thus a crucial component of young people's freedom of expression. On the other hand, social media offers a platform for disinformation, violations of privacy and hate speech. This survey aims to explore how young people exercise their freedom of expression and how they respond to abuses on social media. For this purpose, a questionnaire survey with Turkish university students is used in conjunction with an in-depth interview technique. The research will collect data on the familiarity of students about the definition and content of the freedom of expression, and use of social media by students, and the findings will be analyzed with the results of in-depth interviews. © 2024, Goce Delchev University of Shtip.     THE DIALECTIC OF THE ROME STATUTE: OPPOSITENESS AND UNITY OF THE COMPLEMENTARITY AND CORRECTIVE FUNCTION OF THE INTERNATIONAL CRIMINAL COURT

    Under international law, it is each State’s obligation and responsibility to recognize the most serious crimes committed against the international community, as well as criminalize and conduct effective investigations and prosecution of them. The establishment of a permanent International Criminal Court, whose well-known complementarity principle is one of its central tenets, has finally emerged as a pillar in the fight against the impunity of international crimes. The article derives from various implementations a test for determining the characteristics and functions of the correction function of international law, thus presents the argument that the Rome Statute’s complementary role provides a corrective function. © 2024 Universita degli Studi di Milano.     The Potentials of Economy in Recovery of the Relations Between Türkiye and Armenia

    The Armed conflicts between Azerbaijan and Armenia on 28 March 1993 affected the relations between Türkiye and Armenia negatively. As of 3 April 1993, Türkiye halted grain transport to Armenia and closed the land border between the two countries. In addition to historical problems, the Nagorno-Karabakh crisis appears to be the greatest obstacle to restoration of relations since then. To contribute to the normalization process and regional stability, it is essential that the process of normalization is not confounded by these other complex concerns and that an economic functionalist perspective shall be adopted. The article aims to examine the evolution of Türkiye-Armenia ties over the last two decades, to highlight present issues, and to emphasize why a solution is required considering the societal and diplomatic initiatives achieved thus far to normalize relations, and especially to explore and emphasize economic opportunities for the rapprochement.
